Analysts warn data-center firms face risks after Democratic election wins

The AI infrastructure boom just ran into an obstacle that no amount of GPU spending can solve: voters.

Democratic victories in Texas and Georgia have investors bracing for tighter state oversight of AI data centers. Morgan Stanley is now flagging specific companies that could feel the pinch if new projects stall in the approval queue.

The stakes are large. States where Democrats could move to restrict>Abbott.

That result matters because Texas was already tapping the brakes before anyone voted. Abbott had directed ERCOT, the state’s grid operator, to audit large-load projects and pause certain data-center permits.

Results from that audit are expected around December 10, 2026. Investors now worry the permit freeze could be extended under new leadership rather than lifted.

Morgan Stanley has named developers with significant Texas exposure that could be hit. The list includes Cipher Digital, MARA Holdings, SEI, and Galaxy Digital.

The bank also singled out Innio, a gas-engine manufacturer. Morgan Stanley views it as particularly vulnerable because it anticipates slower bookings in Texas. If fewer data centers get built, fewer of them need on-site power equipment.

Infrastructure, power, chip, and cloud companies tied to near-term buildouts are seen as the most exposed to delays.

Not everyone loses, though. Hyperscalers and utilities could actually benefit, according to analysts. The same goes for established operators that already hold secured capacity.

Why data centers became a ballot issue

The political shift reflects broader concerns about electricity costs, grid reliability, water consumption, and the impact on local communities.

Texas is an especially sensitive case. Its grid operator was already auditing large loads before the election. That suggests concern about the buildout was bipartisan even before the political map shifted.

Georgia adds a second front. Its Democratic wins have raised similar expectations of state-level scrutiny over new AI projects.

What this means for investors and the AI buildout

The more likely outcome is higher approval hurdles in key states rather than a nationwide ban.

Market reactions after the election have already pressured equities tied to infrastructure, power equipment, and cloud computing. Those segments are considered vulnerable because their revenue depends on new projects actually breaking ground on schedule.

The result is a split market. On one side sit companies still waiting on permits or betting on future capacity in Texas and Georgia. On the other sit hyperscalers and operators that already have capacity locked in.

For developers like those Morgan Stanley flagged, companies with heavy Texas exposure may need to reconsider timelines or look for projects in states with friendlier permitting.

With roughly 45% of the planned pipeline in states that could tighten rules, Texas holding about 25% makes it difficult for the industry to route around.

The first concrete marker is the ERCOT audit, with results expected around December 10, 2026. Whether the incoming administration extends the permit pause will signal how aggressive Texas plans to be.
